Today, what we’re witnessing is yet another breach of contract and backstabbing case whereby a Genshin Impact Beta tester got slapped with $78k fine and a suspended account after his friend shared his Beta gameplay footage to the world.
In case you don’t know, before the official launch of each major Genshin Impact update, miHoYo will organise a Closed Beta Test (CBT) for volunteers to take part in the gameplay, feature testing and feedback collection. Volunteers will have to sign a Non-Disclosure Agreement for not leaking the game content. Besides, the volunteers will also need to bind their actual game account as a stake.
While Genshin Impact’s leak is quite common, most of them are actually contributed by seasoned leakers with clean trails. There are some times it happened due to amateur mistake.
To avoid spoilers, we won’t be explicitly sharing any images or videos of the leak. Let’s just summarise it as a video of a boss fight for the upcoming version 2.5 update. The victim shared the Beta gameplay video footage to his friend with UID on-screen. The friend shared the video and the victim received a lawyer letter from miHoYo.
The victim recalls:
Regarding the leak, I’ve always been very cautious. The friend, I’ve known him for a few years, I trust(ed) him, I told him not to disclose (the content).
I never thought, I got backstabbed.
When I got the notice, I was shocked. I asked him and he admitted.
It is complicated. For one, I never thought he would be the one who backstab me. For two, he admitted his fault.
He said his friends ask him to ignore me. Out of guilt, he admitted.
I don’t know how I should face him.
I admit, I’m the one who started this. I signed the NDA, no matter what happened between, I’m the one at fault.
RMB500,000 (~$78,000 fine) is beyond my capabilities, the amount is too much, I don’t feel anything about it.

The victim is wrong for breaching the contract, while the friend is wrong for backstabbing. This is not the first case and it won’t be the last. Let’s just hope this be a warning to those who treat NDA or any sort of contracts/agreements lightly.
